These Terms of Use (“Terms”) govern your relationship with Study Gate Overseas (“Study Gate,” “we,” “us,” or “our”), a sole proprietorship, and your use of the website www.studygate.in (the “Service”) operated by Study Gate Overseas.

These Terms specifically apply to the relationship between Users and Study Gate. They do not govern relationships with subject-matter experts, which are subject to separate, specific terms and conditions.

By accessing or using the Service, you confirm that you accept these Terms and agree to comply with them. If you do not agree to any part of these Terms, you must not access or use the Service.

1. Eligibility

To access or use the Service, you must:

• Be at least 18 years old and legally capable of entering into binding contracts.
• Successfully complete the registration process.
• Accept these Terms.
• Provide accurate, complete, and current contact and billing details.
• Not be subject to any restrictions that legally prohibit the use of this Service.

By using the Service, you affirm that all the above requirements are met and that your use does not violate any laws or regulations. This affirmation is a legally binding representation.

Study Gate reserves the right to refuse service, close accounts, or change eligibility criteria at its sole discretion.

1. Free Trial

Study Gate may, at its discretion, offer a limited-time free trial (“Free Trial”) for its subscription services.

Upon expiration of the Free Trial, you will not be charged unless you opt to continue with a paid subscription.

We reserve the right to:

1. Modify the terms of any Free Trial, or
2. Cancel the Free Trial offer entirely, at any time without prior notice.

1. Fee Changes

Study Gate may revise the pricing of online tests at any time. Any such changes will take effect from the date they are published.

1. Refunds & Cancellations

Refund requests will be evaluated individually and may be granted at the sole discretion of Study Gate. Cancellation of a test must be requested before the test is attempted.

Approved refunds will be processed after deducting a 2% payment gateway transaction fee from the total amount paid.

1. Content Licensing and Intellectual Property

All test materials—including questions and answers—are proprietary to Study Gate. As the sole owner of the content, Study Gate retains full intellectual property rights.

Users are prohibited from copying, distributing, or sharing any content without prior written consent from Study Gate. Any breach of copyright, privacy, or intellectual property rights may result in legal action.

1. Authorized Use of the Service

The Service is intended solely for lawful purposes consistent with the objectives of the TestAS Online Tests offered by Study Gate.

Any unauthorized use may be subject to civil claims or criminal prosecution.

1. Accounts

When creating an account, you must provide accurate and up-to-date information. Failure to do so constitutes a breach of these Terms and may result in account termination.

You are responsible for maintaining the confidentiality of your password and for any activity conducted through your account.

You agree not to share your password or use a username that infringes on others’ rights or is offensive, vulgar, or obscene.

1. Intellectual Property

The Service and all original content, features, and functionality (excluding user-generated content) are the exclusive property of Study Gate and its licensors.

This includes all copyrights, trademarks, and proprietary rights under Indian and international laws. Study Gate also holds exclusive rights to aggregated and anonymized test scores and may use them for service improvements and benchmarking purposes.

1. Third-Party Links

Our Service may contain links to third-party websites or services that are not owned or controlled by Study Gate.

We assume no responsibility for the content, privacy policies, or practices of third-party sites. Use of such third-party services is at your own risk, and we strongly recommend reviewing their respective terms and privacy policies.

1. Data Protection

By using our Service, you acknowledge that your personal data and any content you submit will be processed in accordance with our Privacy Policy.

1. Termination

We may suspend or terminate your account at any time, without prior notice, if you violate these Terms.

Upon termination, all rights to access or use the Service will cease immediately. You may also terminate your account by ceasing to use the Service.

1. Limitation of Liability

Study Gate, including its affiliates, employees, directors, agents, and partners, shall not be liable for any indirect, incidental, consequential, or punitive damages. This includes—but is not limited to—loss of profits, data, goodwill, or other intangible losses resulting from:

1. Your use or inability to use the Service,
2. Third-party conduct on the Service,
3. Any content obtained from the Service,
4. Unauthorized access to or alteration of your data.

This limitation of liability does not apply in cases of intentional misconduct or gross negligence by Study Gate or its senior management.

1. Disclaimer

The Service is provided “as is” and “as available,” without any warranties—express or implied—including but not limited to fitness for a particular purpose, non-infringement, or performance.

Study Gate does not guarantee that:

• The Service will be available at all times or operate without interruptions;
• Defects or errors will be corrected;
• The Service is free of harmful components such as viruses;
• The results obtained from using the Service will meet your expectations.

1. Governing Law

These Terms are governed by and interpreted in accordance with the laws of India. Any disputes will be subject to the exclusive jurisdiction of the competent courts located in New Delhi, India.

Failure to enforce any part of these Terms does not waive our rights. If any provision is deemed unenforceable, the remainder will continue in full force.

1. Changes to Terms

We reserve the right to amend or replace these Terms at any time. If changes are material, we will aim to provide at least 30 days’ notice.

Continued use of the Service after such updates constitutes your acceptance of the revised Terms. If you do not agree with the new terms, you must discontinue use of the Service.

1. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, the remaining provisions will remain valid and enforceable.
